These terms apply to our website, flyheru.com (including its contact form), the Ascend by HERU app (on iPhone, Android and on the web at ascend.flyheru.com, where these terms are published) and the Heru Aviation alerts text-message program, all provided by Heru Aviation, LLC ("Heru Aviation," "we," "us"). By using them you agree to these terms and to our Privacy Policy.

1. Air charter broker disclosure

Heru Aviation acts as your agent in arranging charter flights. We do not own or operate aircraft and do not hold an air carrier certificate. Each flight is operated by an FAA Part 135 certificated air carrier (the "operator"), which has operational control of the flight and is responsible for its safe operation, including the aircraft, crew, maintenance and every decision about whether, when and how the flight operates. Before you book, we tell you which operator will operate your flight. If the operator must change, we tell you before the flight.

2. Quotes and bookings

• Quotes depend on aircraft availability and are not reserved until a trip is confirmed.
• Each trip is governed by its charter agreement, which sets out the price, payment, changes, cancellation and refunds. If the charter agreement and these terms conflict, the charter agreement controls for that trip.
• The operator and the pilot in command may delay, divert or cancel a flight for safety, weather, air traffic control, airport restrictions, crew duty limits or regulatory reasons.
• You are responsible for the accuracy of passenger information and for each passenger having valid travel documents.

3. Accounts and the app

• You must be at least 18 to open an account. Keep your sign-in secure and tell us at once if you suspect misuse.
• You may authorize others, such as family members or an assistant, to manage trips on your account; you are responsible for what they do with that access, and you can withdraw it at any time.
• App features may change. Trip information in the app, including status and checks, is provided to keep you informed and does not replace the operator's own decisions or instructions.

4. Using the website and app

Use the website and app only for lawful purposes. Do not try to access other people's information or accounts, interfere with security, copy or scrape content in bulk, or upload harmful code. The content, logos and design are owned by Heru Aviation or its licensors; you may view and print pages for personal use. Links to other sites are for convenience; we are not responsible for them.

Description

Heru Aviation alerts are trip, travel and operational text messages from Heru Aviation, LLC about the private flights we arrange. Clients and their travel contacts and passengers receive replies to their inquiries, trip confirmations, schedule and aircraft changes, and day-of-travel updates; clients can also receive their Ascend sign-in codes. Heru team members receive scheduling and operational alerts about the trips they support. Vendors who serve our trips (aircraft operators, ground transportation drivers and companies, FBOs and other trip service providers) receive trip requests, confirmations, schedule changes and day-of-trip coordination. Messages are informational; we do not send marketing texts.

Who receives texts

Only people who have agreed to receive them: clients and their travel contacts and passengers; Heru team members; and vendors who serve our trips: aircraft operators, ground transportation drivers and companies, private terminals (FBOs) and other trip service providers.

How to opt in

Clients and passengers tick an unchecked consent box where a mobile number is entered in the Ascend by HERUapp, on the client website or on the contact form on our website, flyheru.com. Team members tick it on their own staff profile. Vendors agree verbally, by email or in their service agreement and a team member records it, or they text START. Every opt-in uses the same wording, shown on our SMS consent page: "I agree to receive trip and travel text messages from Heru Aviation at this number. Message frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to opt out. See our Terms and Privacy Policy."

Privacy

Mobile numbers and SMS opt-in data are never shared with or sold to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See the text-message section of our Privacy Policy and our SMS Alerts Policy.

6. Disclaimers and liability

The website and app are provided "as is." To the fullest extent the law allows, Heru Aviation disclaims implied warranties and is not liable for indirect, incidental, special or consequential damages, or for the acts or omissions of operators and other independent vendors. Nothing in these terms limits liability that cannot be limited by law, or your rights under your charter agreement or under U.S. Department of Transportation consumer protection rules.

7. General

These terms are governed by the laws of the State of New York. We may update them by posting a new version here with its effective date. If any part is unenforceable, the rest remains in effect.
